Copyright Considerations
The "on-screen accessible books" are to be considered alternate format for Persons with Perceptual Disabilities. They fall under the Canadian Copyright Act, section 32 (1). The books can be used in alternate format for students with perceptual disabilities provided an original copy of the book has been purchased and is stored in conjunction with the "on-screen accessible book".
The Canadian Copyright Act defines “perceptual disability” to mean a disability that prevents or inhibits a person from reading or hearing a literary, musical, dramatic or artistic work in its original format, and includes such a disability resulting from
- severe or total impairment of sight or hearing or the inability to focus or move one’s eyes,
- the inability to hold or manipulate a book, or
- an impairment relating to comprehension
Copyright issues are strictly adhered to in order for books to be made accessible in alternate format for special needs students.
